Welcome to Book Your Token! This service is owned and operated by Danavrithi Enterprises (OPC) Private Ltd. ("Company", "we", "us", "our"). These Terms and Conditions ("Terms") govern your use of our platform and services for booking medical appointment tokens ("Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

1. Nature of Our Service

1.1. Platform for Convenience: "Book Your Token" is a technology platform that facilitates the booking of appointment tokens with listed medical practitioners ("Doctors") and the payment of an associated booking fee.

1.2. No Medical Advice: We do not provide medical advice, diagnosis, or treatment. The Service is not a substitute for professional medical consultation. Any doctor-patient relationship is strictly between you and the Doctor you book an appointment with.

1.3. Emergencies: Our Service is NOT intended for medical emergencies. In case of a medical emergency, please contact local emergency services or visit the nearest hospital immediately.

2. User Accounts and Responsibilities

2.1. Accurate Information: You agree to provide accurate, current, and complete information as prompted by the booking form, including patient name, age, contact details, and reason for visit. Providing incorrect or misleading information may affect your token booking or the service you receive from the Doctor.

2.2. Lawful Use: You agree to use the Service only for lawful purposes and in accordance with these Terms.

2.3. Token System Understanding: You acknowledge that token numbers are generated sequentially and any live tracking information provides an estimated queue status. Actual consultation times can vary due to unforeseen medical circumstances, emergencies, or the Doctor's schedule. We are not liable for any delays.

2.4. Communication Consent: By using the Service, you consent to receive communications from us related to your bookings, including but not limited to confirmation messages, updates, and notifications (which may include WhatsApp notifications as indicated on our platform).

3. Booking, Payments, and Fees

3.1. Booking Fee: To secure a token, you are required to pay a non-refundable booking fee ("Booking Fee") as displayed at the time of booking. This fee is for the use of the "Book Your Token" platform and for securing a slot in the Doctor's queue. This fee may be distinct from any consultation fees charged directly by the Doctor or clinic.

3.2. Payment Processing: Payments are processed through our third-party payment gateway, Razorpay. We are not responsible for any errors, data breaches, or issues arising from the payment gateway. Your use of the payment gateway is subject to Razorpay's terms and conditions and privacy policy.

3.3. Confirmation: A token is considered booked only after successful payment of the Booking Fee and issuance of a token number.

3.4. Doctor's Fees: Any additional consultation fees, treatment costs, or other charges levied by the Doctor or the clinic are separate and payable directly to them as per their policies. Our Booking Fee does not cover these charges.

4. Cancellations, Refunds, and "No Show" Policy

4.1. Booking Fee Non-Refundable: The Booking Fee paid through the "Book Your Token" platform is non-refundable.

4.2. Patient Cancellation/No Show: If you cancel your token or fail to be present at the clinic when your token is active (a "No Show"), the Booking Fee will not be refunded. Your token status may be updated accordingly (e.g., 'Cancelled', 'No Show').

4.1. Doctor/Clinic Cancellation or Unavailability: Doctors reserve the right to change their availability or cancel appointments. We will endeavor to communicate any such cancellations if informed by the clinic.

If a Doctor cancels all sessions for the day or is unavailable after your token has been booked and paid for, the refund of the Booking Fee will be at our sole discretion or as per any specific refund policy stated for such events.

4.2. Service Termination by Us: We reserve the right to cancel your token booking and deny service if there is a violation of these Terms, fraudulent activity, or misuse of the platform.

5. Privacy and Data Security

5.1. Privacy Policy: Your privacy is important to us. Our collection, use, and protection of your personal information are governed by our Privacy Policy.

5.2. Information Sharing: By using the Service, you consent that the information you provide (including patient name, contact details, reason for visit, etc.) will be shared with the selected Doctor's clinic for the purpose of your appointment.

5.3. Data Translation: For multilingual support, some information you provide may be translated using third-party services. While we aim to use secure services, you acknowledge that data passes through these services during translation.

5.4. Data Accuracy: While we facilitate the collection of information, we are not responsible for errors in the information provided by you or for how the Doctor's clinic uses this information.

6. Service Availability and Modifications

6.1. Availability: We strive to ensure the "Book Your Token" platform is available, but we do not guarantee uninterrupted access. The Service may be subject to downtime for maintenance, upgrades, or due to unforeseen technical issues.

6.2. Doctor Availability: Information about Doctor availability is based on updates from the Doctors/clinics and is subject to change without prior notice. We are not liable for inaccuracies in Doctor availability.

6.3. Live Tracking: The live tracking feature is provided as an estimate of queue movement. It can be disabled by the clinic at any time, and its accuracy is dependent on real-time updates from the clinic staff.

6.4. Changes to Service: We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

7. Disclaimers

7.1. AS IS Service: The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.2. No Endorsement: Listing of Doctors on our platform does not constitute an endorsement or recommendation by "Book Your Token." The choice of Doctor is solely yours.

7.3. Medical Outcomes: We are not responsible or liable for the quality of medical care, advice, diagnosis, treatment, or any outcomes thereof provided by the Doctors booked through our Service. All medical services are the sole responsibility of the attending Doctor.

8. Limitation of Liability

8.1.

To the fullest extent permitted by applicable law, "Book Your Token" or Danavrithi Enterprises (OPC) Private Limited (including its owners, employees, and affiliates) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
• your access to or use of or inability to access or use the Service;
• any conduct or content of any third party on the Service, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties;
• any content obtained from the Service;
• unauthorized access, use, or alteration of your transmissions or content; or
• the medical services, advice, or treatment provided by any Doctor booked through the Service.

8.2. In no event shall the aggregate liability of Danavrithi Enterprises (OPC) Private Limited for all claims relating to the Service exceed the amount of the Booking Fee you paid for the specific transaction giving rise to the claim, if any.

9. Intellectual Property

All content, trademarks, service marks, logos (including "Book Your Token"), software, and other intellectual property associated with the Service are the property of Danavrithi Enterprises (OPC) Private Limited or its licensors. You are not granted any right or license with respect to these intellectual properties except as expressly stated in these Terms.

10. Modification of Terms

We reserve the right to modify these Terms at any time. If we make changes, we will post the revised Terms on our platform and update the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

11. Governing Law and Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of India.
• Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in India, before a sole arbitrator. The venue of such arbitration shall be Thanjavur, Tamil Nadu. The language of the arbitration shall be English (or Tamil, as agreed by the parties).
• Alternatively, for minor disputes, parties may agree to resolve them through the courts located in Thanjavur, Tamil Nadu.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remaining Terms, which will continue to be in full force and effect.

13. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and "Book Your Token" regarding your use of the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
